International law fully supports Ukraine’s position on Scythian gold

Ukrainian law and international law in the case of the return of Scythian gold is completely on the side of Ukraine.

This was stated in an interview with Ukrinform by Dutch lawyers representing Ukraine’s interests in the case of Scythian gold, Gert-Jan van den Berg and Maarten Sanders, UA writes.

According to Sanders, Crimean museums have said they want to appeal the decision of the Court of Appeal to the Supreme Court of the Netherlands.

“At this stage, only issues of law (not facts) are important. We expect that Crimean museums will object to the application of the Law of Ukraine “On Museums and Museum Affairs”. On the other hand, we will present arguments in favor of the application of the 1970 UNESCO Convention. Both Ukrainian law and international law support the return of treasures to Ukraine. We will prepare for the proceedings in the Supreme Court together with a special adviser at the Supreme Court” – the lawyer said.

He also noted that Ukraine’s position was that international law required the exhibits to be returned to their country of origin in the current situation, and that the exhibits belonged to the state of Ukraine. His colleague Gert-Jan van den Berg added that the case was unique.

“The fact is that this case is unique in the modern history of law. The 1970 UNESCO Convention, which we used to substantiate Ukraine’s claims, together with Ukrainian law, has never been applied in such a case. However, we are convinced that the Convention should resolve such cases” – he said.

Lawyers noted that this case is also of great interest to the Russian Federation.
