Rather than becoming the first instance of frozen Russian central bank reserves being converted into a &#8220;reparations loan&#8221;,&nbsp;<strong>the European Council agreed to provide Ukraine with \u20ac90 billion backed by the Union&#8217;s own budget.<\/strong><\/p>\n   <p>On the surface, this looked like a retreat: the most ambitious scheme had been blocked, and the money was found in a different pocket. Yet behind this retreat, a less visible but more significant development had taken place \u2013 Brussels quietly assembled a legal architecture that renders the freeze almost irreversible. And whether Kyiv can exploit it in time will determine the fate of \u20ac210 billion.<\/p>\n   <p><a href=\"https:\/\/thegaze.media\/news\/frozen-210-billion-how-the-december-2025-compromise-opened-a-legal-window-for-kyiv-and-why-it-must-be-closed-quickly\"><strong>Read the FULL article <\/strong><\/a>by <strong>Ihor Petrenko<\/strong>, Founder of the United Ukraine Think Tank, Doctor of Political Science.<\/p>\n   <p>Petrenko argues that the European Union has gradually developed a mechanism that seeks to make Russia bear the financial consequences of its aggression without directly transferring the burden onto European taxpayers. Approximately \u20ac210 billion in assets belonging to the Russian Central Bank remain immobilized within European financial institutions, accounting for the majority of all frozen Russian sovereign assets held in the West. Against this backdrop, the European Commission proposed a reparations loan framework in autumn 2025, drawing on Article 212 of the Treaty on the Functioning of the European Union.<\/p>\n   <p>The political scientist emphasizes that the proposal did not amount to outright confiscation. Instead, the scheme relied on a more sophisticated financial structure. Cash generated as frozen Russian bonds matured would be reinvested in EU debt instruments, with the resulting proceeds directed to Ukraine. Under this arrangement, Russia would formally retain ownership claims over the assets, while Ukraine would only be expected to repay the loan after Moscow compensated for war damages through reparations.<\/p>\n   <p>According to Petrenko, European Parliament calculations envisioned allocating \u20ac95 billion to macro-financial support, including the repayment of previous G7-backed loans, while a further \u20ac115 billion would be directed toward strengthening Ukraine\u2019s defence industry. The model was designed to address both immediate fiscal needs and long-term security requirements.<\/p>\n   <p>The analyst notes, however, that a major obstacle emerged from the concentration of frozen assets within Euroclear, the Brussels-based securities depository. Approximately \u20ac185 billion of the immobilized Russian reserves, including around \u20ac176 billion in cash holdings, are located there. As a result, Belgium would bear the greatest share of the legal and financial risks associated with any more ambitious use of the funds.<\/p>\n   <p>The expert points out that Belgian Prime Minister Bart De Wever openly opposed proposals that would place disproportionate responsibility on his country. In his view, Belgium should not be left alone to absorb potential legal or financial consequences arising from decisions taken at the European level.<\/p>\n   <p>Petrenko explains that Belgian concerns were rooted in several concrete considerations. The first involved the possibility of legal claims under the 1989 Belgian-Soviet investment treaty, a risk that De Wever described as a \u201csword of Damocles\u201d hanging over his government. The second concerned the stability of Euroclear itself, which could face significant liabilities if sanctions were eventually lifted or Russia succeeded in future legal proceedings. A third concern related to the credibility of the euro as a global reserve currency, which Belgian authorities feared could be undermined by unprecedented asset seizures.<\/p>\n   <p>The author stresses that Belgium consequently insisted on full risk-sharing across the European Union. Brussels sought guarantees that any future legal or financial losses would be collectively borne by all member states rather than by Belgium alone. As an alternative, De Wever proposed providing Ukraine with a \u20ac45 billion loan financed through jointly issued European debt.<\/p>\n   <p>According to the analyst, the eventual compromise adopted by the European Council reflected many of these concerns. Ukraine was granted access to an interest-free \u20ac90 billion loan package covering the period from 2026 to 2027. The financing is backed by EU borrowing and secured through the Union\u2019s budgetary guarantees. Repayment would only be expected once reparations become available, while the frozen Russian assets remain immobilized and may be used to service the debt.<\/p>\n   <p>Petrenko notes that this package covers roughly two-thirds of Ukraine\u2019s projected financing requirements, which the IMF estimated at \u20ac135.7 billion. The remaining needs are expected to be met through support from other G7 partners, excluding the United States.<\/p>\n   <p>The political scientist highlights that by spring 2026 the mechanism had already demonstrated its practical viability. The European Parliament approved the package in February, and the Council adopted the final legislative component in April, enabling the first disbursements to begin during the second quarter of the year. In his assessment, the successful launch of the programme proved that the European Union can act through enhanced cooperation mechanisms even when unanimous agreement among all member states remains elusive.<\/p>\n   <p>The expert argues that this development fundamentally changes the debate for Ukraine. The immediate question of whether financing will be available during the next two years has largely been resolved. Attention is now shifting toward whether the legal and institutional framework already established can eventually evolve into a much larger reparations-based mechanism capable of addressing Ukraine\u2019s future financial needs.<\/p>\n   <p>Petrenko acknowledges that calls for immediate confiscation of Russian assets remain politically attractive. Nevertheless, he contends that such proposals have repeatedly encountered the same barriers: legal uncertainty, concerns about the euro\u2019s international standing, and the risks posed to financial institutions such as Euroclear. By contrast, the loan-based model has demonstrated that it can be implemented within existing European political and legal constraints.<\/p>\n   <p>The analyst therefore views the events of late 2025 as a turning point. Not only did they reinforce the long-term immobilization of Russian sovereign assets, but they also enabled those frozen resources to begin generating tangible financial support for Ukraine.<\/p>\n   <p>In conclusion, Petrenko warns that the opportunity created by this legal framework may not remain available indefinitely. Political shifts within Europe or future negotiations involving the United States and Russia could potentially alter the status of the frozen reserves. He argues that Ukraine\u2019s priority should therefore be to preserve and expand the existing mechanism, transforming the political resistance that characterized the debate in December 2025 into broader European support for a more comprehensive reparations framework in the future.
